1. Acceptance of Terms

Welcome to PointNCounter (the "Platform"), operated at pointncounter.com. By accessing or using the Platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not access or use the Platform.

These Terms apply to all visitors, registered users, and participants in our debates, surveys, and rewards program. By creating an account, posting content, or earning rewards, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Use of the Platform

PointNCounter provides an AI-powered debate forum where users can discuss topics, post arguments, and have factual claims evaluated against verified sources. The Platform also offers a survey and rewards program through integrated third-party providers.

You may use the Platform only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Platform complies with all applicable laws and regulations.

3. User Accounts and Registration

To participate fully in the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. PointNCounter is not liable for any loss or damage arising from unauthorized account access.

4. User Content and Conduct

You are solely responsible for any content you post to the Platform, including debate posts, comments, and profile information. By posting content, you represent that you have the right to do so and that it does not violate any law or third-party rights.

We encourage robust, respectful debate. Content that is honest, on-topic, and supported by evidence strengthens the community. Misleading, abusive, or unlawful content may be removed and may result in account suspension.

5. Prohibited Activities

You agree not to engage in any of the following:

• Posting content that is unlawful, threatening, harassing, defamatory, hateful, or otherwise objectionable.
• Impersonating another person or misrepresenting your affiliation with a person or entity.
• Attempting to interfere with, disable, or disrupt the Platform or its servers.
• Using bots, scrapers, or automated tools to access or collect data from the Platform without authorization.
• Attempting to manipulate the rewards program, surveys, or point balances through fraud or deception.
• Posting spam or promotional content unrelated to the discussion.
• Reproducing, copying, or distributing Platform content in violation of applicable intellectual property laws.

6. Intellectual Property

The Platform, including its design, branding, software, and AI evaluation systems, is owned by PointNCounter and protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the Platform without our written permission.

You retain ownership of the content you post. By posting content, you grant PointNCounter a non-exclusive, royalty-free license to display, reproduce, and distribute that content within the Platform for the purpose of operating and promoting the debate forum.

7. Survey and Rewards Program

PointNCounter offers users the opportunity to earn reward points by completing surveys and offers provided through third-party integrations such as TheoremReach. Points are credited to your account upon verified completion of qualifying activities.

The rewards program operates on a conversion ratio of 100 points = $1.00 USD. Reward balances are non-transferable, may not be exchanged for cash unless explicitly permitted, and may expire or be revoked in cases of fraud, violation of these Terms, or termination of your account.

Third-party survey providers have their own terms and eligibility requirements. PointNCounter is not responsible for a provider's decision to disqualify, screen out, or reject a survey attempt.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available," without warranties of any kind, whether express or implied. PointNCounter does not warrant that the Platform will be uninterrupted, error-free, or that AI-generated evaluations are accurate or complete.

AI fact-checking is a tool to assist discussion, not a definitive source of truth. Users should always exercise independent judgment and verify claims through additional sources before relying on them.

9. Limitation of Liability

To the fullest extent permitted by law, PointNCounter shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Platform.

Our total liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount, if any, you have paid to us in connection with the Platform in the twelve months preceding the claim.

10. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

By using the Platform, you consent to the data practices described in our Privacy Policy.

11. Termination

You may close your account at any time by discontinuing use of the Platform and contacting us. PointNCounter may suspend or terminate your account at any time, with or without cause, including for violations of these Terms.

Upon termination, your right to use the Platform ceases. Any unclaimed reward points may be forfeited in accordance with the rewards program terms.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Material changes will be communicated through the Platform or by other reasonable means.

Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Platform.
